Welcome to Pozt! These Terms of Service ("Terms") govern your use of the Pozt mobile application and related services. By using Pozt, you agree to these Terms in full.
1. About Pozt
Pozt is a hyperlocal social platform that connects people through location-based content sharing. Our service allows you to:
- Share posts, photos, and updates with people nearby
- Discover what's happening in your local area in real-time
- Engage with your community through comments and upvotes
- Stay anonymous while connecting with your surroundings
2. Eligibility
To use Pozt, you must:
- Be at least 13 years old (or the minimum age required in your jurisdiction)
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using our services under applicable law
- Provide a valid phone number for account verification
3. Your Account
Pozt uses device-based identification combined with phone verification. You are responsible for:
- Maintaining the security of your device
- All activity that occurs through your device on Pozt
- Ensuring your phone number is accurate and accessible
We reserve the right to disable accounts that violate these Terms or that we reasonably believe pose a security risk.
4. Location Services
Location is core to Pozt. By using the app, you consent to the collection and use of your location data. Without location access, Pozt cannot function as intended.
Your location is used to:
- Show you posts from nearby users
- Display your posts to users in your area
- Calculate distances for feed relevance
- Target local advertisements (if enabled)
5. User Content & Conduct
5.1 Your Content
You retain ownership of content you create. By posting on Pozt, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content within the service.
5.2 Prohibited Content
You may NOT post content that:
- Harassment: Bullies, threatens, or intimidates others
- Hate Speech: Attacks individuals based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
- Violence: Promotes or glorifies violence, self-harm, or dangerous activities
- Illegal Activity: Facilitates illegal transactions, drug sales, or other criminal behavior
- Adult Content: Contains pornography, nudity, or sexually explicit material
- Misinformation: Spreads false information that could cause harm
- Spam: Repetitive, deceptive, or commercial spam
- Privacy Violations: Shares personal information of others without consent
- Intellectual Property: Infringes on copyrights, trademarks, or other rights
Content Moderation: We use automated systems and human review to detect and remove violating content. Severe or repeated violations will result in permanent account suspension.
6. Premium Services (Pozt+)
Pozt offers optional premium features through in-app purchases:
- All purchases are processed through Apple's App Store
- Prices are displayed in your local currency before purchase
- Subscriptions auto-renew unless cancelled 24 hours before the renewal date
- Refunds are handled according to Apple's refund policies
7. Advertising
Pozt displays advertisements to support our free service. Ads may be:
- Targeted based on your general location (city/region level)
- Shown between content or at natural transition points
- Purchased by local businesses through our ad platform
Premium subscribers may receive reduced or no advertisements.
8. Intellectual Property
Pozt and its original content, features, and functionality are owned by Xayhem LLC. Our trademarks, logos, and service marks may not be used without prior written permission.
9. Disclaimers
Pozt is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not warrant that:
- The service will be uninterrupted, secure, or error-free
- Content posted by users is accurate, reliable, or appropriate
- The service will meet your specific requirements
10. Limitation of Liability
To the maximum extent permitted by law, Xayhem LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of Pozt.
Our total liability for any claims under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
11. Indemnification
You agree to indemnify and hold harmless Xayhem LLC and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of Pozt or violation of these Terms.
12. Termination
We may terminate or suspend your access immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use Pozt ceases immediately.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
14. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated through the app or via notification. Your continued use after changes constitutes acceptance of the modified Terms.
